Terms of Service

Welcome to DZMM.

These Terms of Service ("Terms") govern your access to and use of the services provided through dzmm.io and any associated websites, platforms, applications, or features (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms and all other policies published at https://dzmm.io/legal ("Policies"). If you do not agree, you must stop using the Services immediately.

The Services are operated by the DZMM project team ("DZMM", "we", "us", or "our"), an independently operated online platform. For the purposes of these Terms, "you" and "your" refer to you as the user of the Services.

Key points before you begin:

The Services are for entertainment purposes only. They are not a substitute for professional emotional, psychological, or medical support. If you are in distress, please seek assistance from a qualified professional.
All interactions with AI characters on the Services are entirely fictional. AI characters are software programs designed to simulate conversation. They do not have genuine emotions, intentions, or the ability to take real-world actions. Any content within conversations that may appear to reference real events, people, or outcomes is generated algorithmically and should not be taken literally. We disclaim all responsibility for any misunderstanding in this regard.
The Services rely on AI technology that is inherently imperfect. Generated outputs may be inaccurate, incomplete, or otherwise flawed. You are responsible for evaluating any content produced by the Services.

1. Description of Services

The Services are an online platform that uses artificial intelligence to generate virtual, fictional characters ("AI Characters") with whom you can interact through text, images, voice, and other media. You may select existing AI Characters or create your own by specifying characteristics through our tools.

We may modify, remove, or add characters, features, or content at any time at our sole discretion without prior notice.

2. Accounts

2.1 Registration

Certain features of the Services require you to create a user account ("Account"). When creating an Account, you agree that all information you submit is accurate and complete, and you will keep it up to date. You are solely responsible for all activity under your Account and for maintaining the confidentiality of your login credentials.

Your Account is personal and non-transferable. You may not sell, lend, or share your Account with any other person.

2.2 Account Termination

We reserve the right to suspend, restrict, or terminate your Account at any time, for any reason, including violation of these Terms or Policies. You agree that we will not be liable to you or any third party for any such action.

You acknowledge that you have no ownership or property interest in your Account.

2.3 Inactive Accounts

We reserve the right to delete Accounts that have been inactive for six (6) consecutive months or more. "Inactive" means no login to the Services during that period. Before deletion, we will make reasonable efforts to notify you at the email address associated with your Account at least thirty (30) days in advance. Upon deletion of an inactive Account, all associated data, Content, credits, and subscription entitlements are permanently forfeited and cannot be recovered. No refund or compensation will be provided.

2.4 Account Deletion by You

You may request deletion of your Account at any time by contacting [email protected]. Upon processing your request, your Account and associated data will be permanently deleted within thirty (30) days. Any remaining credits, active subscription time, or other entitlements are immediately forfeited upon deletion and are not refundable. Account deletion is irreversible.

3. Subscriptions and Payments

3.1 Paid Features

Some features of the Services are available only to paid subscribers. The terms, pricing, and payment methods will be presented at the time of purchase. You are responsible for all applicable fees, charges, and taxes.

3.2 Credits

The Services may use a credits system to access certain features such as image generation, voice messages, or other premium content. Credits are non-transferable between users or accounts.

3.2.1 Credit Expiration

Purchased credits expire twelve (12) months from the date of purchase if unused. Bonus, promotional, or complimentary credits may have a shorter expiration period (as specified at the time of issuance, or ninety (90) days if not specified). We will make reasonable efforts to notify you by email before your credits expire, but the expiration occurs regardless of whether such notice is received. Expired credits are forfeited and are not refundable, replaceable, or convertible to cash.

3.3 Auto-Renewal

Subscriptions renew automatically at the end of each billing period for the same duration, unless cancelled before the renewal date. Payment is processed automatically on the first day of the renewed period.

3.4 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription remains active until the end of the current billing period. You will not be charged for subsequent periods.

After cancellation, your access reverts to the free tier. Any remaining credits expire at the end of the billing period and are not refunded or carried over.

3.5 Refunds

All purchases are final. No refunds will be issued except where required by applicable law or in cases of verified billing errors. If you believe a billing error has occurred, contact [email protected] within 7 days of the charge.

By purchasing credits or a subscription, you consent to immediate access to digital content and acknowledge that you waive any applicable cooling-off or withdrawal period to the extent permitted by law.

If a chargeback is filed, the subscription is immediately cancelled and all access to premium features and remaining credits is revoked.

4. User Safety

We prioritize user safety. You should not disclose sensitive personal information (financial details, addresses, passwords, etc.) while using the Services. You are solely responsible for protecting your personal information and should be aware of the risks associated with transmitting information online.

5. Intellectual Property

5.1 Our Property

All intellectual property in the Services, including but not limited to technology, software, designs, text, images, audio, and AI models, is owned by or licensed to DZMM. You are granted a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes only. This license terminates automatically if you violate these Terms.

5.2 Your Content

You may provide input while using the Services and receive output based on your input (collectively, "Content"). You retain ownership of your input. By using the Services, you grant us a non-exclusive, royalty-free, worldwide license to use, process, store, and analyze your Content for the purposes of providing, maintaining, and improving the Services, including training and developing our AI models, content moderation, and ensuring compliance with our Policies.

6. Restrictions

In using the Services, you agree that you will NOT:

Use the Services for any commercial, illegal, or unauthorized purpose;
Modify, reverse-engineer, decompile, or disassemble any part of the Services;
Interfere with or circumvent any security features of the Services;
Attempt to gain unauthorized access to any systems or networks;
Use the Services in any manner that could impair or disrupt operations;
Remove or alter any proprietary notices on the Services;
Access or attempt to access the Services from jurisdictions where the Services are not available (see Section 6.1);
Violate any applicable laws in your use of the Services.

6.1 Geographic Restrictions

The Services are not available in the following jurisdictions:

Sanctioned territories: North Korea, Iran, Syria, Cuba, and the Crimea, Donetsk, and Luhansk regions of Ukraine, or any other jurisdiction subject to comprehensive trade sanctions imposed by major international bodies;
People's Republic of China (excluding Hong Kong SAR and Macau SAR);
United States of America;
Japan;
Singapore;
United Arab Emirates;
Kingdom of Saudi Arabia.

We reserve the right to restrict access from additional regions at any time at our sole discretion and without prior notice. Accessing the Services from a restricted jurisdiction by any means, including the use of VPNs or proxy services, constitutes a violation of these Terms. We may use technical measures, including IP-based geolocation, to enforce these restrictions.

7. Content Responsibility

You are solely responsible for the Content generated through your interactions with AI Characters. The AI Characters respond based on your input and configuration. We do not control or endorse any Content generated by AI Characters. You must ensure that your interactions comply with applicable laws, regulations, and all of our Policies.

8. Content Moderation

We have implemented automated content moderation systems to ensure compliance with our Policies. Content that is flagged may be reviewed, and we may take appropriate action including content removal, account restriction, or reporting to authorities where required.

We reserve the right to remove any Content or de-list any character at our sole discretion. Users will not be refunded for moderation actions taken in response to Policy violations.

We maintain a zero-tolerance policy for child sexual abuse material (CSAM). Any such material is reported to the appropriate authorities.

13. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR MEET YOUR REQUIREMENTS, OR THAT ANY ERRORS WILL BE CORRECTED.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY.

15. Third-Party Links

The Services may contain links to third-party websites or services. We do not endorse or assume responsibility for any third-party content, products, or services. Your use of third-party services is at your own risk.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Hong Kong SAR, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong SAR.

17. Changes to Terms

We may update these Terms at any time. Changes become effective immediately upon posting to the Services. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

18. Complaint Policy

19. Termination

These Terms remain in effect until terminated by either you or us. You may terminate by ceasing all use of the Services and cancelling any active subscription. We may terminate your access at any time, with or without notice, for any reason including breach of these Terms.

We may assign or transfer the Services or these Terms to any third party. Continued use of the Services following such transfer indicates your consent.

20. Referral Program

We may offer a referral program that allows you to invite others to the Services. Please consult our separate Referral Program Terms for the applicable rules and conditions.

21. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.

22. Entire Agreement

These Terms and our Policies constitute the entire agreement between you and DZMM regarding your use of the Services, superseding all prior agreements.
